Sofia Rapp Johansson,  var placerad på olika familjehem under större delen av 90-talet. Hon vanvådrades, misshandlades och våldtogs upprepade gånger medan socialtjänsten stod och såg på.

Men enligt den nya lag, som vanvårdsutredningen ledde fram till och som ger vanvårdade rätt till 250 000 kronor i skadestånd, kan hon inte få någon ersättning.

Lagen ger bara de som vanvårdades före 31 december 1980 rätt till ersättning. Enligt regeringen vill man på så sätt försäkra sig om att ingen får ut dubbla ersättningar. Om brottet inte är preskriberat kan den drabbade nämligen fortfarande få skadestånd från förövaren.

Men för Sofia  har preskriptionstiden gått ut och hon har alltså inte någon chans att få ersättning vare sig från staten eller förövaren. Nu har Sofia  stämt staten för att få igenom en lagändring som skall göra att det ekonomiska ansvaret ligger hos kommunerna när en placering går fel eller vid övergrepp och försummelse.

Sofia vill att vanvården i fosterhemmen ska upphöra och har anlitat en advokatfirma som precis lämnat in en stämning.

But under the new law, which neglect the investigation leading up to and that gives neglected right to SEK 250 000 in damages, she can not get any compensation.

The law allows only those who neglect was before December 31, 1980 is entitled to compensation. The government wants it that way to ensure that no-one gets double compensation. If the offense is not barred, the sufferer namely still get damages from the perpetrator.

But Sofia has the limitation period expired and she has not any chance of getting compensation from either the State or the abuser. Now Sofia sued the state to get through a legislative change that will make the financial responsibility lies with municipalities when an investment goes wrong or when abuse and neglect.

Sofia wants to beatings in foster homes should cease, and has hired a law firm just filed a lawsuit.
